1. SCOPE
The following terms and conditions apply to all orders placed via our online shop. Our online shop is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or self-employed profession. An entrepreneur is a natural or legal person or a partnership with legal capacity who, when entering into a legal transaction, acts in the exercise of their commercial or self-employed professional activity.
2. CONTRACTING PARTY, CONCLUSION OF CONTRACT, CORRECTION OPTIONS
The purchase contract is concluded with Netuschil Enterprise GmbH, Berenbrock 40, 59348 Lüdinghausen, Germany (brand DON DONKEY'S®).
By placing products in the online shop, we make a binding offer to conclude a contract for these items. You can first place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods in the shopping cart by clicking the order button. Immediately after submitting the order, you will receive a confirmation by email.
3. CONTRACT LANGUAGE, STORAGE OF THE CONTRACT TEXT

The German version of these terms and conditions is authoritative. We provide English and French translations for information purposes.
We store the contract text and send you the order data and our terms and conditions in text form. For security reasons, the contract text is no longer accessible via the internet.
4. DELIVERY TERMS
Shipping costs may be added to the stated product prices. Further details on any shipping costs can be found with the offers.
We only deliver by shipment. Unfortunately, collection of goods is not possible.
5. PAYMENT
The payment methods available in each case (e.g. credit card, PayPal, Apple Pay, Google Pay or Klarna) are shown during the ordering process. Payments via third-party providers are additionally subject to their terms. For example:
Credit card
When placing your order, you provide your credit card details. Your card is charged immediately after the order is placed.
PayPal
To pay the invoice amount via the payment service provider PayPal, you must be registered with PayPal, identify yourself with your login details and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. Further information is provided during the ordering process.
6. RETENTION OF TITLE
The goods remain our property until full payment has been made.
7. TRANSPORT DAMAGE
If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us without delay. Failure to make a complaint or to contact us has no consequences whatsoever for your statutory claims and their enforcement, in particular your warranty rights. However, it helps us to assert our own claims against the carrier or the transport insurance.
8. RIGHT OF WITHDRAWAL
Consumers are generally entitled to a statutory right of withdrawal. Details can be found in our cancellation policy.
8.1 Exclusion for fresh donkey milk and donkey cheese
In accordance with Section 312g (2) No. 2 of the German Civil Code (BGB), the right of withdrawal does not apply to contracts for the supply of goods which are liable to deteriorate rapidly or whose expiry date would be quickly exceeded. This applies to our fresh donkey milk delivered frozen and to our donkey cheese delivered chilled, as these goods require an uninterrupted frozen or cold chain, compliance with which can no longer be ensured after delivery. For sets containing fresh donkey milk or donkey cheese, the exclusion applies to these components.
8.2 Donkey milk powder, cosmetics and other items
For donkey milk powder, our cosmetic products and other items (e.g. cups), the statutory right of withdrawal applies in accordance with our cancellation policy.
8.3 Sealed cosmetic products
In accordance with Section 312g (2) No. 3 BGB, the right of withdrawal expires prematurely for contracts for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery. This applies to our cosmetic products, insofar as they are delivered sealed.
Your statutory warranty rights remain unaffected. If you have any problems or complaints regarding the delivered goods, please contact us immediately. We will endeavour to find an accommodating solution.
9. WARRANTY AND GUARANTEES
Application of the statutory liability for defects
Unless expressly agreed otherwise below, the statutory liability for defects applies.
The following limitations and shortened periods do not apply to claims based on damage caused by us, our legal representatives or vicarious agents:
* in the event of injury to life, body or health,
* in the event of intentional or grossly negligent breach of duty and fraudulent intent,
* in the event of breach of essential contractual obligations, the fulfilment of which is essential for the proper performance of the contract and on whose compliance the contracting party may regularly rely (cardinal obligations),
* within the scope of a guarantee, if agreed, or
* insofar as the scope of application of the Product Liability Act is applicable.
10. LIABILITY
For claims based on damage caused by us, our legal representatives or vicarious agents, we are always liable without limitation:
* in the event of injury to life, body or health,
* in the event of intentional or grossly negligent breach of duty,
* in the case of guarantees, if agreed, or
* insofar as the scope of application of the Product Liability Act is applicable.
In the event of a breach of essential contractual obligations, the fulfilment of which is essential for the proper performance of the contract and on whose compliance the contracting party may regularly rely, liability is limited in amount to the damage foreseeable at the time the contract was concluded.
Otherwise, claims for damages are excluded.
11. DISPUTE RESOLUTION
We are neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
